Bell Temple LLP partners Lisa Hamilton and Andrew Lee, and associate, Tina Jian, successfully argued against certification on behalf of two independent homes involved in a class action lawsuit arising from the COVID-19 pandemic, after a three week long certification hearing. While the action was certified against some of the proposed homes, nearly all of the causes of action were disposed of pursuant to the Supporting Ontario’s Recovery Act, 2020 S.O. 2020, c. 26, and the class was restricted to a more limited group of individuals than proposed by plaintiffs’ counsel.
